DESTEK ASSIST SERVICE AND ROADSIDE ASSISTANCE SERVICES CONSULTANCY TRADE LIMITED COMPANY INFORMATION NOTICE ON THE PROCESSING OF PERSONAL DATA
As DESTEK ASSIST SERVICE AND ROADSIDE ASSISTANCE SERVICES CONSULTANCY TRADE LIMITED COMPANY, we attach importance to the privacy and security of your personal data. Within this scope, pursuant to the Turkish Personal Data Protection Law No. 6698, we take the necessary measures to prevent unlawful processing of and access to your personal data and to ensure an appropriate level of security during the processing and transfer of your personal data to third parties. Acting as Data Controller under the Personal Data Protection Law and the relevant legislation, we process your personal data within the framework described below.
1. Definitions
Personal Data: Any information relating to an identified or identifiable natural person.
Personal Data Protection Law: Law No. 6698 on the Protection of Personal Data, published in the Official Gazette on 7 April 2016.
Data Controller: The natural or legal person who determines the purposes and means of processing personal data and is responsible for the establishment and management of the data recording system.
Data Processor: The natural or legal person who processes personal data on behalf of the Data Controller based on the authority granted by the Data Controller.
Processing of Personal Data: Any operation performed on personal data, whether fully or partially by automatic means or by non-automatic means provided that it is part of a data recording system, including collection, recording, storage, retention, alteration, reorganisation, disclosure, transfer, takeover, making available, classification or prevention of use.
2. Personal Data Processed
Identity Information: Name and surname, identity card, driving licence, passport, Turkish identity number, tax identity number, vehicle registration records and plate information.
Contact Information: Home address, e-mail address, mobile phone and residence information.
Bank Account Data: Bank account number, IBAN and credit card number.
Data Relating to the Security of Company Premises: CCTV records, visitor records and entry-exit logs.
Customer Tracking Information: Customer number and customer transaction information.
Visual and Audio Records: Voice recordings, call records and camera recordings.
3. Purposes of Processing Personal Data
Your personal data may be processed by our Company in accordance with the basic principles stipulated by the Personal Data Protection Law and within the scope of the personal data processing conditions and purposes set out in Articles 5 and 6 of the Law.
Your personal data may be collected, recorded, stored, processed, classified, updated and transferred to third parties located in T??rkiye in accordance with the procedures and principles set out in the Law and this Information Notice for the following purposes:
Preparing and executing service contracts; fulfilling our obligations regarding roadside assistance and assistance services; responding to your questions and requests; providing promotions, reminders and information about our services; informing you about new products, services, special offers and campaigns; sharing announcements and information directly or indirectly related to our activities by e-mail, newsletter, SMS or phone calls; carrying out commercial activities and protecting our legitimate interests; carrying out information security, training, accounting, emergency management, product and service sales, after-sales services, contract processes, customer relationship management, customer satisfaction, marketing analysis, advertising, campaign and communication processes; evaluating information and suggestions for the improvement of these processes; and responding to information requests from official authorities.
4. Transfer of Processed Personal Data
Your personal data processed for the purposes stated above may be transferred to our domestic business partners, agencies, suppliers such as towing companies and repair services, company officials, shareholders, legally authorised public institutions and organisations, and private persons within the framework of the personal data processing conditions and purposes specified in Articles 8 and 9 of the Personal Data Protection Law.
While carrying out its operations, our Company may share personal data with business partners for the management of administrative, legal, technical, marketing, financial and litigation processes, the monitoring of customer invoicing processes, the execution of supplier and subcontractor agreements and brand management.
5. Method and Legal Basis of Personal Data Collection
Your personal data may be collected verbally, in writing or electronically, through automatic or non-automatic methods, via our call centre, agency panels, website, SMS notifications, social media channels, parties with whom we have a business relationship or from whom we receive complementary services, contracted organisations and similar channels within the scope of our commercial activities.
Your personal data may be processed on the legal grounds that processing is directly related to the establishment or performance of a contract, processing is necessary for compliance with a legal obligation, processing is necessary for the establishment, exercise or protection of a right, or processing is necessary for the legitimate interests of the Data Controller provided that it does not harm the fundamental rights and freedoms of the data subject. Your data may also be processed and shared in line with the purposes set out in this Information Notice.
6. Your Rights Regarding the Processing of Personal Data
Pursuant to Article 11 of the Personal Data Protection Law, you may apply to our Company and submit the following requests:
a) To learn whether your personal data is processed and, if processed, to request information regarding such processing.
b) To learn the purpose of processing your personal data and whether it is used in accordance with that purpose.
c) To learn the third parties in T??rkiye to whom your personal data has been transferred.
d) To request correction if your personal data has been processed incompletely or inaccurately.
e) To request deletion, destruction or anonymisation of your personal data if the reasons requiring its processing cease to exist under Article 7 of the Law.
f) To request that correction, deletion, destruction or anonymisation operations be notified to third parties to whom your personal data has been transferred.
g) To object to any result against you arising from analysis of processed data exclusively through automated systems.
h) To request compensation if you suffer damage due to unlawful processing of your personal data.
As the data subject, you may submit your requests regarding the processing of your personal data and your rights under the Law and this Information Notice through the communication channels below. Requests must be submitted in writing through our communication channels in accordance with the Communique on the Procedures and Principles of Application to the Data Controller. Applications will be evaluated by our Company and concluded free of charge within thirty days at the latest, depending on the nature of the request. If the process requires an additional cost, a fee may be requested in accordance with the tariff determined by the Personal Data Protection Board.

7. Measures Regarding the Protection of Personal Data
The protection of personal data is important for DESTEK ASSIST SERVICE AND ROADSIDE ASSISTANCE SERVICES CONSULTANCY TRADE LIMITED COMPANY. Our Company takes the necessary measures to protect personal data against unauthorised access, loss, misuse, disclosure, alteration or destruction. We undertake to keep your personal data confidential and to take all necessary technical and administrative measures to ensure confidentiality and security. If personal data is damaged or obtained by third parties as a result of attacks on the website or system despite the information security measures taken, our Company will immediately notify you and the Personal Data Protection Board.
8. Keeping Personal Data Accurate and Up to Date
Users acknowledge that the accuracy and up-to-date maintenance of the information they share on the website is important for exercising their rights over their personal data under Law No. 6698 and other relevant legislation. Users accept and declare that they are fully responsible for any consequences arising from providing incorrect information.
9. Deletion, Destruction or Anonymisation of Personal Data
Personal data processed for the purposes set out in this Terms of Use and Privacy / Personal Data Protection Policy and Information Notice may be deleted, destroyed or anonymised when the purpose requiring processing ceases to exist under Article 7/1 of Law No. 6698 and when the periods stipulated by other legislation expire.
10. Changes to the Privacy / Personal Data Protection Policy and Information Notice
DESTEK ASSIST SERVICE AND ROADSIDE ASSISTANCE SERVICES CONSULTANCY TRADE LIMITED COMPANY may amend this Information Notice on the Processing of Personal Data. Such changes will become effective immediately once the revised text is published on the company website.
By accepting this information notice and using our systems, you acknowledge that DESTEK ASSIST SERVICE AND ROADSIDE ASSISTANCE SERVICES CONSULTANCY TRADE LIMITED COMPANY may process your personal data as Data Controller within the framework set out above under the Personal Data Protection Law and the relevant legislation.
